Agreement and operator
These Terms of Service govern access to and use of Kestrello, including kestrello.com, its music-notation studio, playback tools, learning pages, and related services (collectively, the “Service”). The Service is operated by Turnip Games, LLC, a Wisconsin limited liability company (“Turnip Games,” “we,” “us,” or “our”).
By accessing or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.
Eligibility
You must be at least 13 years old to use the Service. If you are under the age of legal majority where you live, a parent or legal guardian must review and agree to these Terms for you. The Service is intended for a general audience and is not directed to children under 13.
The Service and local projects
Kestrello provides browser-based tools for creating, editing, playing, importing, and exporting musical scores. Projects, preferences, and downloaded playback assets are generally stored on your device through browser storage and caches. Kestrello does not currently provide a hosted account or cloud backup for scores.
You are responsible for maintaining copies of your work. Clearing browser data, changing browsers or devices, private-browsing behavior, storage limits, or software errors may delete locally stored projects or playback assets.
Your scores and content
As between you and Turnip Games, you retain any rights you hold in original scores, arrangements, text, metadata, and other material you create or import into Kestrello (“User Content”). Because the current Service processes User Content locally, you do not grant Turnip Games a general license to publish or commercialize it.
You represent that you have the rights needed to use, arrange, reproduce, perform, import, and export your User Content. Kestrello does not determine whether a composition, edition, recording, image, or other work is protected in your jurisdiction. You remain responsible for permissions, royalties, notices, and other legal obligations connected with your use.
Public-domain examples and editorial content
Kestrello includes learning excerpts based on compositions believed to be in the public domain in the United States. A public-domain designation applies to the underlying historical composition identified on the page. It does not automatically apply to a modern edition, engraving, arrangement, recording, photograph, translation, or editorial note.
Kestrello’s original interface, source code, score transcriptions, selection and arrangement of material, articles, explanations, and visual design may contain protectable elements. Unless a page or license says otherwise, those original elements are © 2026 Turnip Games, LLC. Historical facts and genuinely public-domain source material remain free of that claim.
Acceptable use
You may not use the Service to violate law or third-party rights, distribute malware, probe or disrupt the Service, defeat access or security controls, overload infrastructure, misrepresent authorship, or publish material you know you lack the right to use. You may not use automated means to scrape or reproduce the Service in a manner that materially burdens it or creates a competing collection of Kestrello’s original editorial content.
Third-party materials and notices
The Service incorporates or accesses third-party software, audio, photographs, and reference materials under their own terms. Those materials are not owned by Turnip Games merely because they appear in Kestrello.

Company, product, composer, and work names may be trademarks or identifying names of their respective owners. Their use does not imply sponsorship or endorsement.
Copyright complaints
If you believe material made available through Kestrello infringes your copyright, email legal@tourn.app with your name and contact information, identification of the protected work, the exact URL or material at issue, a statement of your good-faith belief that the use is unauthorized, a statement that the information is accurate and that you are authorized to act, and your physical or electronic signature.
Because Kestrello projects are currently stored locally rather than publicly uploaded to our servers, Turnip Games generally cannot access or remove material stored only on a user’s device. We may remove or disable material that we control when a sufficiently supported claim warrants it.
Changes and availability
The Service may change, add or remove features, experience interruptions, or be discontinued. We may suspend access when reasonably necessary to protect the Service, users, or third parties. We do not promise that browser formats, project data, imports, exports, engraving, or playback will remain compatible with every device or third-party file.
Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, TURNIP GAMES DISCLAIMS ALL EXPRESS AND IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, AND DATA PRESERVATION. KESTRELLO IS A CREATIVE TOOL, NOT LEGAL ADVICE ABOUT COPYRIGHT, LICENSING, OR PUBLIC-DOMAIN STATUS.
Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TURNIP GAMES AND ITS MEMBERS, MANAGERS, EMPLOYEES, CONTRACTORS, AND LICENSORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, PROFITS, REVENUE, GOODWILL, OR USE. TURNIP GAMES’ TOTAL LIABILITY ARISING FROM THE SERVICE WILL NOT EXCEED THE GREATER OF US$50 OR THE AMOUNT YOU PAID TURNIP GAMES FOR THE SERVICE DURING THE 12 MONTHS BEFORE THE CLAIM.
Some jurisdictions do not allow certain exclusions or limits. In those jurisdictions, the limitations apply only to the extent permitted by law.
Indemnification
To the extent permitted by law, you will defend, indemnify, and hold harmless Turnip Games from claims, damages, losses, and reasonable costs arising from your User Content, your infringement or violation of another person’s rights, or your material violation of these Terms.
Governing law and disputes
Wisconsin law governs these Terms without regard to conflict-of-law rules. Any dispute not resolved informally will be brought exclusively in the state courts located in Dane County, Wisconsin, or the federal court with jurisdiction over that county. You and Turnip Games consent to those courts’ jurisdiction and venue.
General terms and contact
These Terms and the Privacy Policy are the entire agreement concerning the Service. If a provision is unenforceable, it will be limited to the minimum extent necessary and the remainder will continue. Failure to enforce a provision is not a waiver. You may not assign these Terms without our consent. We may assign them as part of a merger, reorganization, financing, or transfer of the Service.
We may update these Terms by posting a revised version and changing the effective date. Material changes apply prospectively. Questions may be sent to Turnip Games, LLC at legal@tourn.app.
